Terms of Use

Please read these terms before using the app or joining a tournament. By creating an account, joining a tournament, submitting a catch, or using COUNT THE CATCH, you agree to these Terms of Use and the rules published by the applicable tournament organizer.

1. What COUNT THE CATCH provides

COUNT THE CATCH provides software for discovering tournaments, registering participants, recording catch videos, reviewing submissions, displaying results, and tracking CTC Score. We provide the technology; each tournament organizer is responsible for the tournament they create, including its rules, eligibility, schedule, entry fees, prizes, judging decisions, and communications.

2. Eligibility and account responsibility

You must be at least 18 years old to create an account or use COUNT THE CATCH. You must provide accurate information and protect your login credentials. You are responsible for activity performed through your account and may not share, sell, or impersonate another account.

3. Tournament rules and acceptance

Every tournament may have additional rules, deadlines, species requirements, measurement standards, locations, fees, prizes, and liability conditions. Those rules appear in the tournament details or are supplied by the organizer. You must read and accept them before participating. If a tournament rule conflicts with these Terms, these Terms control the use of the app and the organizer rule controls the competition, unless applicable law requires otherwise.

4. Catch evidence and truthful submissions

Tournament evidence must use the photo or video mode required by that tournament and be recorded through the app when documenting the catch. Do not submit substituted, manipulated or misleading evidence. Fishing Journal entries may include photos imported from your gallery; importing them does not make them valid tournament evidence. Submit accurate species and measurements and respect tournament deadlines. A queued upload is not a completed submission until the server confirms receipt.

5. Review, rejection, and disputes

Submissions may be reviewed by the organizer or authorized reviewers. A submission can be rejected, removed, or marked ineligible when the video, content, species, timing, location, identity, or other entry requirement cannot be verified. Review and dispute deadlines are governed by the tournament rules. COUNT THE CATCH may keep the technical record but does not guarantee that an organizer decision will be changed.

6. Fair play and prohibited conduct

You may not cheat, manipulate a video or measurement, use another person's catch, spoof location or device data, submit the same catch more than once, interfere with another participant, abuse the review process, scrape the service, attack the service, upload malware, or use the app for unlawful activity. Location and device fraud — including GPS spoofing, using VPNs or proxies to falsify eligibility or verification, or submitting catches from outside the permitted area — will result in immediate removal from the affected tournaments and may result in a permanent ban from the Service. We may remove submissions, reverse points, suspend accounts, or block access when we reasonably believe these Terms or tournament rules were violated.

7. CTC Score and achievements

CTC Score and achievements are reputation and participation features inside the app. They have no cash value and do not guarantee prizes, ranking in a particular tournament, sponsorship, employment, or other benefit. Verified activity may add points under the published scoring legend. Points may be corrected or reversed after a rejection, deletion, fraud finding, duplicate submission, technical correction, or other legitimate review. We may update the scoring model prospectively and will show the applicable scoring information in the app.

8. Content and license

You retain ownership of your content. You authorize COUNT THE CATCH to host, process, review, transmit and display it as needed to provide the features you request, administer tournaments, provide support and prevent fraud. Public display follows the sharing choices and tournament participation features you use; private content is not automatically licensed for advertising. Promotional use of your private content or Google sign-in identity requires separate authorization consistent with applicable law and provider policies. You must have the rights and permissions to submit content involving other people.

9. Privacy and device permissions

Depending on the feature, the app may request camera, microphone, photo library, notification and location permissions. A one-time device location or GPS metadata from media may be used to record and verify a catch. Location also supports features you request, such as maps, local forecasts and links to regional fishing agencies. The app does not continuously track your location. See the Privacy Policy for use, sharing and choices. Do not submit another person’s private information without permission and a lawful reason.

10. Entry fees and prizes

Entry fees are set by the tournament organizer and are paid directly to the organizer. COUNT THE CATCH does not process, collect, or hold entry fees or prize money, and never takes a cut of either. Joining a tournament is always free for anglers. The organizer keeps 100% of the entry fee and remains responsible for tournament rules, refunds, taxes, prize delivery, cancellations, and promotional promises. Participants should review those terms before paying or joining. Organizers can expand tournament capacity with optional angler packs purchased in the app (see the Pricing page). CTC Pro is an optional subscription (US reference prices: US$2.99 per month or US$29.99 per year, confirmed at purchase; a 7-day monthly trial is available to eligible new subscribers only; annual plans are charged once per year; taxes may apply) with the benefits described in the app, billed through your app store. CTC Pro renews automatically until cancelled, and you can cancel at any time in your app store settings. All prices are in U.S. dollars unless stated otherwise.

11. Payments and disputes

Purchases made inside the app (CTC Pro, angler packs, and Tournament Boost) are billed by the Apple App Store or Google Play under that store's terms; failed, cancelled, or expired purchase attempts are not proof of payment. Tournament entry fees are paid directly to the organizer, outside the platform, so questions, refunds, and disputes about an entry fee are handled between the angler and the organizer under the tournament's published rules. Catch appeals inside the app are handled separately from any payment dispute. COUNT THE CATCH does not hold entry or prize funds and cannot reverse payments it did not process.

12. Safety and legal compliance

Fishing involves risks, including water, weather, boats, equipment, wildlife, traffic, and physical injury. You are responsible for your own safety, supervision of minors, licenses, permits, conservation rules, boating and all other applicable laws. Do not fish, drive, ride a boat, or handle equipment while distracted by the app. The app does not replace local authorities, legal advice, or emergency services.

13. Availability and technical limits

We work to keep the service available, but internet coverage, device storage, battery, camera hardware, operating-system restrictions, maintenance, and third-party services may affect uploads or access. Offline storage helps preserve a pending video, but it is not a guarantee against loss, damage, corruption, theft, or an expired tournament deadline. Keep your device charged and follow the tournament submission window.

14. Disclaimers

To the maximum extent permitted by law, COUNT THE CATCH is provided “as is” and “as available,” without guarantees that every feature, submission, review, tournament, result, prize, or upload will be uninterrupted, error-free, or available in every location. We are not responsible for an organizer's rules, decisions, conduct, payments, prizes, fishing conditions, personal injury, property loss, unlawful conduct, or disputes between users. Nothing in these Terms excludes rights or protections that cannot legally be excluded.

15. Limitation of liability

To the maximum extent permitted by law, in no event will COUNT THE CATCH, its owners, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Service, even if advised of the possibility of such damages. Our total aggregate liability for all claims arising out of or related to these Terms or the Service will not exceed the greater of (a) the amounts you paid to COUNT THE CATCH in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars (US$100).

16. Indemnification

You agree to indemnify, defend, and hold harmless COUNT THE CATCH and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content or submissions; (b) your violation of these Terms, any tournament rules, or any law; (c) your fraud, cheating, or manipulation of the Service; or (d) claims by other users or organizers arising from your participation in the Service.

17. Changes, suspension, and termination

We may improve, change, suspend, or discontinue features and may update these Terms. We will show the new date when the Terms change. Continued use after an update means you accept the revised Terms. We may suspend or terminate your access immediately and at our sole discretion for violations of these Terms, suspected fraud or cheating, chargeback or payment abuse, security risks, legal requirements, or to protect the Service and its users. Provisions concerning content, disputes, liability, indemnification, and amounts already owed continue as locally applicable.

18. Copyright complaints

If you believe content on the Service infringes your copyright, send a notice to [email protected] including: (a) identification of the copyrighted work; (b) identification of the infringing material and where it appears on the Service; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature. We may remove allegedly infringing content and terminate the accounts of repeat infringers.

19. Dispute resolution and binding arbitration

Please contact us first: most disputes can be resolved informally within thirty (30) days. If not resolved, any dispute arising out of or related to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Miami-Dade County, Florida or by video conference. You and COUNT THE CATCH agree that disputes will be resolved only on an individual basis: neither party may bring or participate in a class, collective, or representative action, and claims of different users may not be consolidated. Either party may still seek relief in small-claims court for qualifying claims. You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by emailing [email protected] with your name and a clear statement that you opt out. If the class-action waiver is found unenforceable, the dispute will proceed in court under Section 20.

20. Governing law and jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to Section 19, any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.

21. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. These Terms, together with the Privacy Policy and any tournament rules you accept, are the entire agreement between you and COUNT THE CATCH regarding the Service. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. Section headings are for convenience only.
